Flower Mound Oil & Gas Advisory Board Public Hearing

Residents of Flower Mound....time is running out to let the Flower Mound Oil & Gas Advisory Board know how you feel and what you would like to see in the ordinance recommendations submitted to Town Council.

Saturday, February 12th, 9:00 am to Noon, you will have another opportunity to make a public comment. The Public Hearing will be held at Town Hall, 2121 Cross Timbers Road. Please show up and let your voice be heard.

The OGAB will hand their final recommendations to the Town Council. This is the most important thing to happen in this town for a long time. What ends up in the ordinance may affect your quality of life, health, wealth, and property values.

Some Titan Leases at Hilliard may be expiring...is yours?

According to filings with Denton County and public record testimony at a recent Texas state hearing, a lease you signed with Titan Operating may be or might have already expired. Many leases were signed with effective dates of January 2008 with lease terms of only 3 years and contained language such as the following...."for as long as hydrocarbons are produced in payable quantities.". Here's the problem, although the Hilliard 1H North Unit and 1H South Unit wells have been drilled, they have not been completed nor are they producing, but don't take our word for it.

According to recent testimony from VP of Operations for Titan Operating, LLC, Chris Hammack, there maybe some issues with the leases as currently held.

From recorded public, sworn testimony....

Q. "And you said it was drilled and completed. So has it been completed?"
A. "It has not. I said it would be drilled and completed."

Q. "So is it producing now?"
A. "No, sir, it is not."

Q. "Has it produced anything?"
A. "No, sir, it has not."

Some may say that the "force majeure" clause may come into play, however, force majeure predicates itself on the fact that the event must be "outside the control"of Titan. In this particular case, the wells could have been completed and gas produced from the unit, but according to Mr. Hammock's own testimony, it has not. Since nothing precluded Titan from completing and producing from the unit under the Hilliard tract, it can easily be argued that force majeure does not apply.

Industry Asks Academy to Consider Gasland Ineligible For Oscar

Energy in Depth (EID), the industry group that spends most of it's time fighting federal regulation of the Oil and Gas Industry, sent a letter to the Academy of Motion Picture Arts and Sciences claiming Gasland should be ineligible for Best Documentary Oscar. This shouldn't come as a big surprise since EID is closely affiliated with the Independent Petroleum Association of America (IPAA). EID's Executive Director, Lee Fuller is the IPAA's Vice President of Government Affairs.

The letter states the following:

As found on the Academy’s official website, on a page entitled “Special Rules for the Documentary Awards,” a feature-length documentary film can only be considered eligible for Oscar consideration if, among many other things, it is a “theatrically released nonfiction motion picture dealing creatively with cultural, artistic, historical, social, scientific, economic or other subjects.” Importantly, the description also indicates that the film must maintain an “emphasis … on fact and not on fiction.” As we demonstrate below and in the attached, the film GasLand, which was nominated for an award in this category late last month, falls short of this description in a number of significant ways.

EID has been trying to discredit Gasland for months and months. Josh Fox released this "Affirming Gasland" back in September. We can only hope the Academy sees through the EID lies and awards Gasland this well-deserved honor.
